On November 16, 2024, at approximately 1110 hours, a Pocono Township Police Department Officer was observing traffic at the intersection of SR0715 and SR0314 in Henryville. The Officer observed a gray BMW 3-series traveling at a high rate of speed through the intersection, without stopping at a clearly posted stop sign. The vehicle proceeded South on SR0715 at a high rate of speed, passing vehicles and driving into oncoming traffic while being pursued by the Officer. The vehicle failed to stop despite the Officer's patrol lights and sirens being activated. The pursuit of the vehicle was terminated at the intersection of SR0715 and SR0611.

Through further investigation, the vehicle was identified as being owned by the defendant in this matter, Jerry Dean Harper, a 60-year-old male from Henryville. Harper matched the description of the male operating the vehicle during the pursuit. Additional investigation and search warrants produced digital evidence placing Harper in the vehicle at the time of the pursuit. An arrest warrant was obtained for Harper on January 15, 2025.
