PUBLIC NOTICE OF HEARING AND OF INTENTION TO ENACT PROPOSED ORDINANCE TAKE NOTICE that the Board of Supervisors of Jackson Township will hold a public hearing on Thursday, October 17, 2024 beginning at 5:30 P.M., at the Jackson Township Municipal Building, 2162 Route 715, Reeders, PA 18352. The purpose of the hearing is to consider a pro-posed ordinance to amend Jackson Township’s Zoning Ordinance. The proposed or-dinance contains new definitions of certain terms and provides regulations for so-lar commercial facilities. At the time of the public hearing, the Supervisors will listen to comments by mem-bers of the public concerning the proposed ordinance. If substantial amendments are not offered to the draft of the proposed ordinance, the Su-pervisors intend to consider enactment of the proposed ordinance immediately after the public hearing. The proposed ordinance is entitled: AN ORDINANCE AMENDING CHAPTER 27 (ZONING) OF THE JACKSON TOWNSHIP CODE OF ORDINANCES TO IN-CLUDE REGULATIONS FOR SOLAR COMMERCIAL FACILITIES. The following is a brief sum-mary of all of the provisions of the proposed ordinance, which, if adopted, will be-come part of Chapter 27 of the Jackson Township Code of Ordinances (i.e., the Jackson Township Zoning Ordinance): Article 1 contains a short title; legal authority; legislative intent and pur-pose; and addresses legal conflicts with the proposed ordinance. Article 2 contains amendments to Chapter 27 of the Township’s Code of Ordinances. Those amendments include the removal of “solar power generation, commercial” as a use that is permitted in the Residential (R-1), Village (V), Recreation Com-mercial (RC), Commercial (C), and Industrial (I) dis-tricts, and to allow “solar commercial facilities” in the Commercial and Industrial districts as conditional uses; the amendment of Section 1007 (Alternative Energy Re-quirements) to add a new subparagraph requiring an affidavit and certification for certain solar/wind energy systems; the amendment of Section 1602 (Definitions) to amend, add, and delete cer-tain terms used in the ordinance; and the deletion of Section 1236 (Solar Power Generation, Commercial) in its entirety and its replacement with new regulations for “Solar Commercial Facilities.” Article 3 provides for the ordinance to be effective 5 days after its enactment. A copy of the proposed ordinance will be posted on the Township’s website and also has been supplied to the Po-cono Record and to the Mon-roe County Law Library. Anyone may inspect the pro-posed ordinance (without charge) or obtain a copy of it (for a charge not exceeding actual copying costs) at the Township’s office at the ad-dress listed above during regular business hours.
