PUBLIC NOTICE OF INTENTION TO ENACT PROPOSED ORDINANCE Borough Council of the Borough of Delaware Water Gap hereby gives public notice of its intention to enact the ordinance summarized below at a meeting of Borough Council to be held on Monday, July 1, 2024, at 7:00 p.m. at the Borough Building, 49 Main Street, Delaware Water Gap, Pennsylvania 18327. At the meeting, Council will listen to comments by members of the public concerning the proposed ordinance. If substantial amendments are not offered to the draft of the proposed ordinance, Council intends to consider enactment of the proposed ordinance immediately following receipt of public comment. The proposed ordinance is entitled: AN ORDINANCE OF THE BOROUGH OF DELAWARE WATER GAP, MONROE COUNTY, PENNSYLVANIA, REGULATING THE USE OF CONSUMER AND DISPLAY FIREWORKS, INCORPORATING THE DEFINITION OF DISPLAY FIREWORKS WITHING THE BOROUGH AND PROVIDING FOR PERMITS IN CERTAIN CASES AS WELL AS PROVIDING FOR CIVIL PENALTIES FOR VIOLATIONS OF THE ORDINANCE. The following is a brief summary of all of the provisions of the proposed ordinance. Section 1 provides definitions of terms used in the ordinance; Section 2 sets for the scope of ordinance; Section 3 makes it unlawful to possess or use display fireworks within the Borough of Delaware Water Gap without obtaining a permit sets forth the limitations and requirements of permit for display fireworks and prohibits the use of consumer fireworks in the Borough; Section 4 provides that the ordinance does not prohibit use of signal devices and blank cartridges in certain circumstances; Section 5 allows for seizure of fireworks; Section 6 provides for violations and civil penalties; Sections 7 and 8 contain severability and disclaimer clauses; Section 9 states that the failure to enforce the ordinance is not a waiver of the requirements of the ordinance; Section 10 contains a repealer clause; and, Section 11 provides that the ordinance to be effective five days after its enactment. Copies of the proposed ordinance may be examined without charge or obtained for a charge not greater than the actual cost of reproduction thereof at the Borough Building, at the address above, during the hours of 9:00 a.m. to 1:00 p.m., Monday through Friday. Also, a copy of the proposed ordinance has been supplied to the Pocono Record and the Monroe County Law Library.
