PUBLIC NOTICE TO ACQUIRE LAND IN TRUST ACTION: Notice of decision to acquire land into trust pursuant to 25 Code of Federal Regulations, Part 151. SUMMARY: The Regional Director, Midwest Regional Office, Bureau of Indian Affairs, U.S. Department of the Interior, on the below date, made a determination to acquire real property in trust for the Bay Mills Indian Community. The land is described as follows: FOUR SEASONS PARCEL: A parcel of land located in the Fractional Northeast 1/4, Section 4, Township 46 North, Range 02 West, Superior Township, Chippewa County, Michigan, more particularly described as commencing at the East 1/4 Corner of said Section 4, said point is the POINT OF BEGINNING: Thence S87?43’30” W along the East-West 1/4 line of said Section 4 a distance of 1320.30 feet to the Center-East 1/16th corner of said Section 4 as presently monumented by a ½” iron rerod with cap No. 27450; Thence S87?45’06” W along said East-West 1/4 line a distance of 43.87 feet; Thence N19?47’31”W a distance of 300.54 feet; Thence S70?12’29”W a distance of 10.00 feet; Thence N19?47’31”W a distance of 16.00 feet; Thence N70?12’29”E a distance of 10.00 feet; Thence N19?47’31”W a distance of 28.82 feet to a point on the Southerly right of way line of West 6 Mile Road as presently monumented by a 1/2 rerod with cap No. 27450; Thence N71?07’36”E along said Southerly right of way line a distance of 161.97 feet to a point on the East 1/16th line of said Section 4; Thence N70?00’00”E along said Southerly right of way line a distance of 86.26 feet to a point on the Westerly line of the exception to Parcel “A” as described in Liber 1316, Page 1277 of the Chippewa County Records; Thence S20?00’00”E along the Westerly line of said exception a distance of 100.00 feet; Thence N70?00’00”E along the Southerly line of said exception a distance of 200.00 feet; Thence N20?00’00”W along the Easterly line of said exception a distance of 100.00 feet to a point on the Southerly right of way line of said West 6 Mile Road; Thence N70?00’00”E along said Southerly right of way line a distance of 1096.43 feet to a point on the East line of the Fractional Northeast 1/4 of said Section 4 as presently monumented by a 1/2 rerod with cap No. 27450; Thence S01?58’34”E along said East line a distance of 796.60 feet to the POINT OF BEGINNING. Also known as and being the same land described in Liber 1316, Page 1277 of the Chippewa County Records, recorded on March 4, 2020. Containing 18.091 acres more or less. Subject to all easements, conditions, reservations, exceptions, and restrictions contained in prior conveyances of record. DATE: This determination was made on November 7, 2024. SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement under 25 CFR 151 that notice be given of the decision by the authorized representative of the Secretary of the Interior to acquire land in trust. A copy of the determination is available from the office identified in the FOR FURTHER INFORMATION section of this notice. Any party who wishes to seek judicial review of this decision must first exhaust administrative remedies. This decision may be appealed to the Interior Board of Indian Appeals, 801 North Quincy Street, Suite 300, Arlington, Virginia 22203, in accordance with 43 CFR §§ 4.310-4.340. Your notice of appeal to the Board must be signed by you or your attorney and must be mailed within 30 days of the date that you receive this decision. It should clearly identify the decision being appealed. If possible, attach a copy of the decision. You must send copies of your notice of appeal to (1) the Assistant Secretary – Indian Affairs, 1849 C Street, N.W., Washington, D.C. 20240; (2) each interested party known to you, and (3) this office. Your notice of appeal sent to the Board of Indian Appeals must certify that you have sent copies to these parties. If you file a notice of appeal, the Board of Indian Appeals will notify you of further appeal procedures. If no appeal is timely filed, this decision will become final for the Department of the Interior at the expiration of the appeal period. No extension of time may be granted for filing a notice of appeal.
