PUBLIC NOTICE PROPERTY LOCATED AT 365 NORTH COURTLAND STREET, EAST STROUDSBURG PID:05730112778312,MAP: 05-6.2.8.3,ZONE; C-2 OWNER OF RECORD: SHASHI ADHIKARI, 713 MAIN STREET, Stroudsburg PA NOTICE IS HEREBY GIVEN THAT PURSUANT TO THE CODE OF THE BOROUGH OF EAST STROUDSBURG ZONING SECTION 157-16 CERTIFICATE OF NON-CONFORMING USE OR STRUCTURE, THE OWNER OF THE PROPERTY LOCATED AT 365 NORTH COURTLAND STREET, EAST STROUDSBURG, PA. 18301 â PROPERTY ID 05730112778312 HAS APPLIED FOR A CERTIFICATE OF NON-CONFORMANCE. THE PROPERTY IS LOCATED WITHIN AQUIFER PROTECTION ZONE 2. THE PROPERTY IS OPERATING AS A GASOLINE STATION. THE OWNER HAS PROVIDED INFORMATION INDICATING THAT THE GASOLINE STATION OPERATION HAS OPERATED SINCE 07/05/1979 WHICH PREDATES THE AQUIFER PROTECTION ZONE ORDINANCE ADOPTED IN 1992. SECTION 157-104.B(5) USE REGULATIONS IN THE AQUIFER PROTECTION ZONE PROHIBITS-THE STORAGE OF HYDROCARBON PRODUCTS, EXCEPT FOR HEATING OIL AND VEHICLE FUEL STORED IN VEHICLE TANKS. SECTION 157-104.B(9) USE REGULATIONS IN THE AQUIFER PROTECTION ZONE PROHIBITS AUTOMOTIVE SERVICE STATIONS AND PUBLIC GARAGES. THE EXISTING CANOPY IS AN ACESSORY STRUCTURE. THE FRONT YARD SEBACK VARIES BETWEEN 1.53 FT AND 2.09 FEET AS SHOWN ON THE AS-BUILT SURVEY FOR 365 NORTH COURTLAND STREET PREPARED BY GEORGE FETCH PLS DATED REVISED 4/20/24. SECTION 157-52. B REQUIRES-UNATTACHED STRUCTURES ACCESSORY TO NON-RESIDENTIAL BUILDINGS SHALL COMPLY WITH FRONT AND SIDE YARD REQUIREMENTS FOR THE PRINCIPAL STRUCTURE AND SHALL HAVE A MINIMUM REAR YARD OF AT LEAST 10 FEET. THE MAXIMUM HEIGHT OF SUCH STRUCTURES SHALL BE 1 1/2 STORIES OR 15 FEET. SECTION 157- 36 REGULATIONS GOVERNING THE SIZE OF LOTS, YARDS AND BUILDINGS, TABLE OF BULK REGULATIONS REQUIRES A 10 FOOT FRONT YARD SETBACK.
