PUBLIC NOTICE PROPERTY LOCATED AT 190 KING STREET, EAST STROUDSBURG PID; 05730107686588, MAP: 05-5.1.12.2, ZONE ; OM-1 OWNER OF RECORD: PERCEPTION LLC. NOTICE IS HEREBY GIVEN THAT PURSUANT TO THE CODE OF THE BOROUGH OF EAST STROUDSBURG ZONING SECTION 157-16 CERTIFICATE OF NON-CONFORMING USE OR STRUCTURE, THE OWNER OF THE PROPERTY LOCATED AT 190 KING STREET, EAST STROUDSBURG, PA. 18301*PROPERTY ID 05730107686588, TAX MAP NO:05-5.1.12.2 HAS APPLIED FOR A CERTIFICATE OF NONCONFORMANCE.THE PROPERTY IS LOCATED WITHIN THE OM-1 OFFICE MANUFACTURING DISTRICT. THE PROPERTY IS PRESENTLY USED FOR STORAGE AND DISTRIBUTION OF HEATING OIL AND KEROSENE AND FOR 3 COMMERCIAL RENTALS IN AN EXISTING BUILDING. THE PROPERTY IS AN AQUIFER PROTECTION OVERLAY ZONE 2 AS SHOWN ON THE ZONING MAP OF THE BOROUGH OF EAST STROUDSBURG SECTION 157-104.B(5) AQUIFER PROTECTION OVERLAY ZONE-USE REGULATIONS PROHIBITED USES PROHIBITS -The storage of hydrocarbon products, except for heating oil and vehicle fuel stored in vehicle tanks. THE AQUIFER PROTECTION ZONE AND REGULATIONS WERE ADOPTED BY ORDINANCE IN APRIL 1990. THE APPLICANT HAS SUBMITTED INFORMATION INDICATING THAT THE USE OF THE PROPERTY FOR THE STORAGE OF HEATING OIL AND KEROSENE PREDATED THE ADOPTION OF THE AQUIFER PROTECTION ZONE RESTRICTIONS. SECTION 157-36 REGULATIONS GOVERNING THE SIZE OF LOTS, YARDS & BUILDINGS -TABLE OF BULK REGULATIONS FOR THE OM-1 ZONE ALLOWS MAXIMUM IMPERVIOUS AREA TO BE 855. EXISTING IMPERVIOUS AREA IS 90.9% SECTION 157-65 ENTRANCE AND EXIT DRIVES WIDTH NOT TO EXCEED 40 FT. THE WESTERLY ENTRANCE DRIVE IS 112.9FT AND THE EASTERLY DRIVEWAY IS 50 FT. SECTION 157-67 OFF STREET LOADING REQUIRES A LOADING SPACE TO BE 14FT BY 40 FT. THE EXISTING OFF STREET LOADING SPACE IS 10 FT BY 20 FEET. SECTION 157-66 .B LANDSCAPING AND SCREENING REQUIRES A 10 FT LANDSCAPED STRIP ALONG THE FRONT PROPERTYLINE. NO LANDSCAPE STRIP EXITS. 157-62 .A(1) GENERAL SIGN REGULATIONS STATES THAT THE SUPPORTING STRUCTURE FOR ANY FREE STANDING SIGN SHALL NOT BE CLOSER THAN 3 FEET FROM ANY PROPERTY LINE. THE EXISTING FREE STANDING SIGN STRUCTURE IS LOCATED ON THE FRON PROPERTY LINE. SECTION 157-64.A(1) REQUIRES HANDICAPPED PARKING SPACES. NO HANDICAP PARKING SPACES ARE EXISTING. THE APPLICANT HAS SUBMITTED A SITE PLAN FOR PERCEPTION LLC PREPARED BY ROBERT L. COLLURA DEPICTING THE ABOVE NON CONFORMITIES. COPIES OF THE APPLICATION MAY BE EXAMINED WITHOUT CHARGE OR OBTAINED FOR A CHARGE NOT GREATER THAN THE ACTUAL COST OF REPRODUCTION AT THE EAST STROUDSBURG CODE OFFICE AT 66 ANALOMINK STREET, EAST STROUDSBURG PA. 18301 DURING NORMAL BUSINESS HOURS FROM 8:00 AM UNTIL 5:00 PM MONDAY THRU FRIDAY.
