NOTICE OF INTENTION TO ADOPT ORDINANCE AND PUBLIC HEARING AMENDMENTS TO POLK TOWNSHIP ZONING ORDINANCE REGARDING SOLAR POWER GENERATION, COMMERCIAL The Polk Township Board of Supervisors shall hold a public hearing on the 26th day of August, 2024 at 5:30 p.m. at the Polk Township Municipal Building, 165 Polk Township Road, Kresgeville, Pa., for the purpose of considering amendments to the Polk Township Zoning Ordinance relative to Solar Power Generation, Commercial as defined in the Ordinance at code § 400-303. The Board of Supervisors may adopt the Ordinance at the regular meeting of the Board commencing at 6:30 p.m. on the same date. The proposed amendments are as follows: 1. Zoning Ordinance § 400, attachment 1:3, Schedule of Uses in R-2 Rural/Village Residential district is amended to remove “Solar Power Generation, Commercial” from the list of “Conditional Uses” in the attachment. 2. Zoning Ordinance § 400-847(B)(1), delete existing language and replace with the following: All Commercial Solar Power Generation (CSPG) applications shall be conditional uses in accordance with Attachment 1, Schedule of Uses; C Commercial District, and RR Rural Residential District, of this chapter. Such uses shall also meet the requirements of the Polk Township Subdivision and Land Development Ordinance (SALDO). 3. Zoning Ordinance § 400-847(C)(1)(c), delete existing language and replace with the following: “The setback for solar collectors, all structures, equipment containers and associated mechanical facilities shall be 100 feet from all property lines; however, the setback will be 250 feet from property lines of any adjoining properties in an R-1, R-2, or R-3 Zone, or any property improved with any residential dwelling. All substations, transformers and similar equipment shall be 500 feet from all property lines.” Any interested party is invited to attend.
