NOTICE NOTICE IS HEREBY GIV-EN that the Hamilton Township Zoning Hearing Board will hold a public hearing at the Hamilton Township Municipal Building, 229 Fenner Avenue, Sciota, Pennsylvania 18354 com-mencing at 6:30 p.m., prevailing time, on August 6, 2024 for the purpose of hearing the Application of Frederick C. Bauer, Jr. for a dimensional variance from the ten (10’) foot minimum side yard setback with respect to an installed in-ground swimming pool which as installed has a three (3’) foot setback from the common property line with Lot No. 19 in the White Oak Country Estates subdivision. The Applicant contends that the requested variance is a di minimis variance. In addition, the Applicant is re-questing a variance by estoppel since he alleges that he obtained Permits from Hamilton Township to install the swimming pool in its current position. The Applicant also contends that the lot in question is a lawful nonconforming lot which is burdened by severe slopes. The Applicant states that the as built survey of the installed swimming pool determined that the easterly corner of a pavilion on the Property and approximately thirty (30’) feet of the retaining wall constructed by the Applicant encroach onto the adjoining property being Lot No. 19 owned by Bruce and Pamela Torley. The Property of the Applicant in question is located at 4121 Crestview Drive, Stroudsburg, Pennsylvania 18360 and has been assigned Monroe County Tax Assessment PIN #07628800434443. The Property is in Zoning District A. The Applicant is requesting relief pursuant to: (a) Section 804 of the Hamilton Township Zoning Ordinance, (b) Article VII pertaining to nonconforming lots, uses and structures, and (c) an interpretation under Section 802. A copy of the Applicant’s Application, the full text of the Township Zoning Ordinance, and a complete copy of the Township Zoning Map are available for public inspection prior to the date of the hearing which inspection must occur at the Hamilton Township Municipal Building, 229 Fenner Avenue, Sciota, Pennsylvania 18354 between the hours of 7:30 a.m. and 4:00 p.m., prevailing time, Monday through Friday on business days which are not Federal or State public holidays. The public and all interested persons are invited to attend the public hearing and to present all relevant evidence in connection therewith.
