NOTICE OF PUBLIC HEARING INTENT TO ENACT ORDINANCE NO. 1402 TAKE NOTICE, that the East Stroudsburg Borough Council will hold a public hearing during the regular meeting of Borough Council to enact Ordinance No. 1402, Moving and Storage Centers, on the 21st day of May, 2024, at 7:15 PM in the Borough of East Stroudsburg Municipal Building, 24 Analomink Street, East Stroudsburg, PA. After the hearing and during the continuance of the regular meeting, the Borough Council will, if in order, consider, and vote upon the Ordinance as well as conduct any other business which may come before the Borough Council at that time. The full, attested text of the proposed Ordinance can be reviewed at the Monroe County Law Library, the Pocono Record, the East Stroudsburg Municipal Building at 24 Analomink Street, East Stroudsburg, PA during normal business hours (8:00 AM to 5:00 PM, Monday through Friday, excluding holidays), and online at the East Stroudsburg Borough Website www.eaststroudsburgboro.org. Copies of the full text of the proposed Ordinance can be purchased at the East Stroudsburg Municipal Building for the actual cost of reproduction. In lieu of setting forth the full text of the proposed Ordinance, a summary is set forth herein: In the Ordinance, a new use, Moving and Storage Centers, Section 157-100.12, is added to the existing Section 157-100 of the Borough of East Stroudsburg Code of Ordinances Chapter 157, Zoning, which outlines specific use standards for moving and storage centers, as well as standards for a moving and storage center that include a Propane or Liquefied Petroleum Gas Dispensing Station. The Ordinance shall: 1) amend Section 157-30, Definitions, by adding definitions for “Moving and Storage Center” and “Storage and Warehousing;” 2) amend Section 157-39, 157 Attachment 1, Table of Use Regulations, by adding Moving and Storage Centers as a Commercial Conditional Use in the OM-1 Zoning District; 3) amend Section 157-36, 157 Attachment 2, Table of Bulk Regulations, by adding to footnote 4 that the maximum Building Height shall be increased to 100 feet in the OM-1 Zoning District, provided it meets certain setback requirements; 4) amend Section 157-58.A, Signs, by adding to the table of “Sign Regulations for Commercial Industrial Districts,” “OM1” in place of “M-1,” “or C-1B” after “C1-A,” and “IE” after “INST-EU;” 5) amend Section 157-58.B, Signs, by adding that on-premises wall sign height requirements for buildings exceeding 30 feet may have a maximum height of the height of the building, provided they only advertise primary on-premises goods and services; 6) amend Section 157-64.C, Regulations for offstreet parking spaces, by adding Moving and Storage Center to the end of the chart and indicating the number of parking spaces required based upon calculating 0.2 parking spaces per 1,000 square feet of gross building floor area.; and, 7) amend Section 157-66, Landscaping and screening, Paragraph B, by adding a sentence to the end of the paragraph indicating that landscaping is not required on a Limited Access Highway where there is a grade of more than 10 feet between the elevation of the nearest travel lanes and the nearest adjacent proposed site improvement; all of which are deemed to be in the Borough’s and its residents best interest. The Ordinance authorizes the officers of the East Stroudsburg Borough Council to take the appropriate steps to effectuate the intent of the Ordinance. The Ordinance makes severable any provision which is found invalid or illegal and, further, repeals all prior provisions of the East Stroudsburg Borough Zoning Code that are in direct conflict with this Ordinance. The Ordinance shall be effective upon its approval as provided by law.
