MIDDLE SMITHFIELD TOWNSHIP NOTICE TO BIDDERS SEALED PROPOSALS will be accepted by the Middle Smithfield Township Board of Supervisors until 2:00 p.m. on Thursday, May 9, 2024 at the Middle Smithfield Township Municipal Building, 147 Municipal Drive, East Stroudsburg, PA 18302 for the following: BASE BID: • 35,881 SY. Single Bituminous Seal Coat using a Polymer Modified Emulsion and #8 Stone with a 1.0% Loss by Wash, Surface Category Condition “C”, ADT 100 All materials must meet PennDOT Publication 408 Specifications and Standards. Bidders must be PennDOT prequalified and must supply proof of prequalification. Proposals must be on forms provided by the Township. Proposal forms, specifications and bid information can be obtained at the Middle Smithfield Township Municipal Building at the above address or by calling 570-223-8920 ext. 112, Monday through Friday, 8:00 a.m. to 4:00 p.m. Bids must be clearly marked “SEALCOAT PROPOSAL FOR LETTING of MAY 9, 2024. The bid must be accompanied by a certified check or bid bond in the amount of 10% of the bid. The successful bidder will be required to provide Performance and Payment Bonds in the amount of 100% of the contract price within 20 days of the award of the contract. All bids will be opened and read publicly at a regular meeting of the Middle Smithfield Township Board of Supervisors on Thursday, May 9, 2024 at 7:00 p.m., at the Middle Smithfield Township Municipal Building (address above), or as soon thereafter as the agenda allows. The Board of Supervisors tentatively expects to award a contact at the same meeting, or publicly announce the date of the next meeting it intends to consider award of the contract. The Pennsylvania Public Works Employment Verification Act (Act 127 of 2012) applies to the project. As a precondition of letting any contract, the successful bidder must file a form with the Township verifying that all employees hired after January 1, 2013 are legally eligible to work in this country. All work under the contract must be performed by July 31, 2024, unless excused as provided in the bid specifications. The liquidated damages in the amount of $975.00 per day will be assessed for each day completion is delay beyond the allowed time deadline. No Bidder may withdraw his bid within sixty (60) days after the date set for the opening of the bids. The Township reserves the right to reject any and all bids for any cause whatsoever, to eliminate any item or items from the contract, and to waive any informalities, irregularities, or technicalities, including typographical errors, in the bids.
