NOTICE OF DEEMED APPROVAL NOTICE IS HEREBY GIVEN by Gregory Kessel and Jaclyn Kessel that, due to the failure of the Borough of East Stroudsburg to commence a hearing on Mr. and Mrs. Kessel’s Application to the Zoning Hearing Board asserting an appeal from Zoning Officer’s Denial of Certificate of Non-Conformance Commercial Use-C-1 and a Dimensional and Use Variance—the structure is not usable consistent with R-1 requirements, Parcel no. 05-4.1.10.29-1 located in the Borough of East Stroudsburg, Monroe County, PA, and commonly known as 187 Grand Street, East Stroudsburg, PA 18301, pursuant to 53 P.S. §10908(1.2) (2011), the Borough of East Stroudsburg has failed to observe the time limits of 53 P.S. §10908 that requires a first hearing before the Zoning Hearing Board be commenced within 60 days from the date of receipt of the Applicant’s Application, unless the Applicant has agreed in writing to an extension of time.
