PUBLIC NOTICE - COMPLAINT Court of Common Pleas of Monroe County 43rd Judicial District Commonwealth of Pennsylvania No. 8226 CIVIL 2022 Bruce Tilley, Plaintiff vs. Darissa Simpson and Keith Stacks, Defendant TO: DARISSA SIMPSON You are hereby notified that, on October 31, 2023, Plaintiff Bruce Tilley filed a Complaint against you in the Court of Common Pleas of Monroe County, Pennsylvania, docketed to Number 8226 Civil 2022. The Complaint, which was endorsed with a Notice to Defend, alleged, in essence, as follows: 1. Plaintiff is the owner of real property and a residence located at 25 Jonathans Way, Henryville, Pennsylvania which you rented pursuant to a Lease Agreement on July 18, 2020; 2. The Lease provided for a term of one (1) year commencing on July 18, 2020, with a monthly rental payment of One Thousand Eight Hundred Dollars ($1,800.00) due on the first day of each month during the term; 3. You entered into possession of the leased premises on July 18, 2020, in accordance with the terms of the Lease; 4. Your lease was extended on a month-to-month basis after the first year and until you were evicted from the leased premises on March 28, 2022, through an Order of Possession granted by District Magistrate Daniel Kresge; 5. At or prior to the time when you were evicted from the premises, you damaged the leased premises and otherwise breached the Lease by failing to surrender the leased premises in substantially the same condition in which it was leased to you. 6. The damages to the leased premises were substantial. 7. Plaintiff had to repair the damage at a cost in excess of $35,000.00. 8. The repairs took numerous months to complete resulting in lost rental income in excess of $24,000.00. Plaintiff respectfully requested that the Court enter judgment against you in the amount of Fifty-Nine Thousand Eight Hundred Fifty Dollars and Seventy-Five Cents ($59,850.75) for repairs, replacements, and lost rent, together with costs, interest and all attorneys fees incurred by Plaintiff. After the Complaint was filed, Plaintiff made a diligent search and inquiry and was unable to locate you and/or you avoided service of the Complaint. Consequently, Plaintiff filed a Motion in the Court of Common Pleas of Monroe County and the Court Ordered that the above Notice be served upon you by publication as provided by the Pennsylvania Rules of Civil Procedure. You are hereby notified to appear and plead to the said Complaint within TWENTY (20) days after the publication of this Notice, or default judgment may be entered against you. If you wish to defend, you must enter a written appearance personally or by an Attorney and file your defenses or objections in writing with the Court. You are warned that if you fail to do so, the case may proceed without you and a judgment may be entered against you without further notice for the relief requested by the Plaintiff.
