PUBLIC NOTICE OF INTENTION TO ENACT PROPOSED ORDINANCE Borough Council of the Borough of Delaware Water Gap hereby gives public notice of its intention to enact the ordinance summarized below at a meeting of Borough Council to be held on Monday, May 5, 2025, at 7:00 p.m. at the Borough Building, 49 Main Street, Delaware Water Gap, Pennsylvania 18327. At the meeting, Council will listen to comments by members of the public concerning the proposed ordinance. If substantial amendments are not offered to the draft of the proposed ordinance, Council intends to consider enactment of the proposed ordinance immediately following receipt of public comment. The proposed ordinance is entitled: AN ORDINANCE OF THE BOROUGH OF DELAWARE WATER GAP TO REGULATE SHADE TREES WITHIN THE BOROUGH OF DELAWARE WATER GAP. The following is a brief summary of all of the provisions of the proposed ordinance. Section 1 states the name of the Ordinance; Section 2 sets forth the mission and purpose of ordinance; Section 3 provides definitions of terms used in the ordinance; Section 4 establishes a Shade Tree Committee; Section 5 details membership in the committee; Section 6 provides for the powers of the committee; Sections 7 sets forth how the committee makes recommendations; Section 8 provides for a permit for shade trees; Section 9 describes the maintenance requirements for shade trees on private property; Section 10 sets forth pruning standards; Section 11 describes planting of trees; Section 12 contains tree care on private property within Borough; Section 13 sets forth standards for removal of stumps; Section 14 describes prohibited activities; Section 15 sets liability for damage; Section 16 describes violations and penalties; Section 17 states that contain severability clause; Section 18 contains a repealer clause; and, Section 19 provides that the ordinance to be effective five days after its enactment. Copies of the proposed ordinance may be examined without charge or obtained for a charge not greater than the actual cost of reproduction thereof at the Borough Building, at the address above, during the hours of 9:00 a.m. to 1:00 p.m., Monday through Friday. Also, a copy of the proposed ordinance has been supplied to the Pocono Record and the Monroe County Law Library.
