East Stroudsburg Borough Zoning Hearing Board re: 30,000 Gallon Propane Tank

Public NoticeNOTICE IS HEREBY GIVEN that the East Stroudsburg Borough Zoning Hearing Board (the Board) will hold a public hearing at the East Stroudsburg Borough Municipal Building located at 24 Analomink Street, East Stroudsburg, Pennsylvania 18301 commencing 7:00 p.m., prevailing time, on August 1, 2024 for the purpose of hearing the Application of Perception, LLC (the Applicant) for Special Exception approval of an LPG Bulk Plant and 30,000 gallon above-ground propane storage tank subject to the provisions of the Pennsylvania Propane and Liquid Petroleum Gas Act (Act 61) 35 Pa. Stat. Ann Satin 1329.1329.19 (Act). The Applicant contends that the Act preempts certain sections of the Borough Code including the Special Exception provisions as well as other provisions of the Borough Code. In the event the Borough Zoning Hearing Board finds that the Special Exception and other provisions of the Borough Code are not preempted by the Act, the Applicant is seeking approval for the expansion of an existing nonconforming use and other dimensional nonconformities on the hereinafter described Property so that the Applicant may install and operate on the Property an LPG Bulk Plant and 30,000 gallon above-ground propane storage tank for the storage and distribution of propane to residential and commercial customers.The Property in question is located at 190 King Street, East Stroudsburg, Pennsylvania 18301 (the Property). The Property is located in District OM-1 and bears Tax Property Map No. 5-5.1.12.2 and Property Identification No. 0530107686588.A copy of the Applicant's Application, the full text of the Borough Zoning Ordinance, and a complete copy of the Borough Zoning Map are available for public inspection prior to the date of the hearing which inspection may occur at the East Stroudsburg Borough Municipal Building at 24 Analomink Street, East Stroudsburg, Pennsylvania between the hours of 8:00 A.M. and 5:00 P.M., prevailing time, Monday through Friday on business days which are not federal or state public holidays.
